Most divorce matters can be seen most clearly through a cost/benefit analysis. Plainly stated, most folks benefit from a resolution of conflict that does not entail a full-blown trial. With litigation, comes cost and risk. Both can often be eliminated through a settlement of the controversy. Most divorces involving property and children can be complex. For that reason, most do not resolve until the parties have completed mediation. By that time in the proceeding, full financial discovery has been shared. The use of outside experts such as accountants, psychologists, or vocational rehabilitation experts has been discussed. The parties know that failure to settle at mediation will result in additional attorney fee costs. It is not unusual for controversies to be mediated more than one time.
