1. Introduction
Peacock, Gaffney, & Damianakis, P.A. (hereinafter referred to as “the Firm,” “we,” “us,” or “our”) is a law firm organized and operating under the laws of the State of Florida. The Firm is committed to protecting the privacy and confidentiality of all individuals who visit our website (hereinafter referred to as “the Site” or “our Site”).
This Privacy Policy describes the types of information that may be collected when you visit our Site, how that information is used, and the steps we take to safeguard it. This policy applies to all visitors and users of our Site, regardless of location, though it is specifically designed to address the requirements of Florida law and applicable federal standards.
Please read this Privacy Policy carefully. By accessing or using our Site, you acknowledge that you have read, understood, and agree to be bound by the terms of this Privacy Policy. If you do not agree with the terms stated herein, please discontinue use of the Site immediately.
This Privacy Policy does not govern information collected through offline means, in person, by telephone, or through any other channel outside of this website.
2. Information We Collect
2.1 Automatically Collected Information
When you visit our Site, certain non-personally identifiable technical information is automatically collected by our analytics service provider, Google Analytics. This information is collected in aggregated and anonymized form and may include:
- Internet Protocol (IP) address (anonymized and truncated prior to storage);
- Browser type and version;
- Operating system;
- Pages visited and the order in which they were visited;
- Date and time of each visit;
- Time spent on each page;
- Referring URLs (the web address from which you navigated to our Site); and
- General geographic location (at the country or region level only).
This automatically collected information does not, by itself, identify any individual visitor. It is used solely for the purpose of understanding how our Site is used and improving the overall user experience.
2.2 Personally Identifiable Information
Our Site does not contain any contact forms, registration pages, login portals, or e-commerce checkout functions. As a result, the Firm does not actively solicit, collect, or store any personally identifiable information (PII) through the Site itself. No visitor is required or asked to submit their name, address, email address, telephone number, or any other identifying information through this website.
Visitors who wish to contact the Firm must do so directly by telephone or by visiting our office in person. Please see Section 13 of this Policy for contact details.
2.3 Cookies
Our Site uses cookies. A cookie is a small text file placed on your device (computer, tablet, or mobile phone) by a website when you visit it. Cookies are widely used to make websites function properly and to provide analytical information to website operators.
Our Site may place or allow the placement of the following types of cookies:
- Strictly Necessary Cookies: These cookies are required for the basic operation of our Site, including functionality provided by the WordPress content management platform on which the Site is built. Without these cookies, core features of the Site may not operate correctly.
- Analytics Cookies: These cookies are set by Google Analytics and collect anonymized, aggregated information about how visitors use the Site. This data helps us understand visitor behavior and improve Site content and structure.
Our Site does not use advertising cookies, behavioral tracking cookies, or any cookies designed to build profiles of individual users for marketing purposes.
3. How We Use Information
The Firm uses the limited, anonymized information collected through our Site solely for the following legitimate operational purposes:
- To analyze overall website traffic patterns and understand how visitors interact with the Site;
- To identify which pages and content are most useful to visitors;
- To diagnose and address technical issues affecting Site performance; and
- To improve the structure, content, and usability of the Site over time.
The Firm does not use any information collected through this Site for the following purposes:
- Targeted advertising or marketing profiling;
- Sale, rental, trade, or sharing of personal information with third parties for commercial gain;
- Automated decision-making or profiling of individual visitors; or
- Any purpose inconsistent with this Privacy Policy.
4. Google Analytics
This Site uses Google Analytics, a web analytics service provided by Google LLC (“Google”), a company headquartered at 1600 Amphitheatre Parkway, Mountain View, California 94043, USA. Google Analytics uses cookies and similar technologies to collect and analyze information about how visitors use our Site.
4.1 Data Collected and Anonymization
The information generated by Google Analytics cookies relating to your use of the Site — including your IP address — is transmitted to and stored by Google on servers in the United States. The Firm has enabled IP anonymization (also known as “IP masking”) on this Site. This means that Google truncates and anonymizes your IP address before it is stored, such that it cannot be used to identify any specific individual.
All data provided to the Firm through Google Analytics is presented in aggregated and anonymized form only. The Firm does not receive, view, or store any report that identifies individual visitors.
4.2 Google’s Use of Data
Google may use data collected through Google Analytics in accordance with its own privacy policy and terms of service. The Firm has no control over Google’s independent data practices. Visitors are encouraged to review Google’s Privacy Policy, available at:
https://policies.google.com/privacy
4.3 Opting Out of Google Analytics
Visitors who wish to prevent their data from being collected and used by Google Analytics may install the Google Analytics Opt-out Browser Add-on, which is available at no cost from Google at the following address:
https://tools.google.com/dlpage/gaoptout
This add-on instructs the Google Analytics JavaScript to prohibit transmitting information about your website visit to Google Analytics. Installation of this add-on does not affect your ability to use our Site.
5. Cookies
5.1 How We Use Cookies
As described in Section 2.3 above, our Site uses strictly necessary cookies (set by the WordPress platform) and analytics cookies (set by Google Analytics). These cookies serve the limited purposes of maintaining basic site functionality and collecting anonymized traffic data. The Firm does not use cookies to track individual users, serve targeted advertisements, or build behavioral profiles.
5.2 Controlling and Disabling Cookies
You have the ability to control and manage cookies through your web browser settings. Most modern browsers allow you to:
- View the cookies currently stored on your device;
- Delete some or all cookies;
- Block cookies from specific websites; and
- Block all cookies from being set.
Instructions for managing cookies in common browsers are generally available through the browser’s “Help,” “Settings,” or “Preferences” menus. You may also refer to the browser developer’s support documentation for specific guidance.
Please be aware that disabling or blocking cookies — particularly strictly necessary cookies — may impair or prevent certain features of our Site from functioning as intended. The Firm is not responsible for any reduced functionality resulting from a visitor’s choice to disable cookies.
5.3 No Advertising or Tracking Cookies
The Firm does not use, permit, or authorize advertising networks, or any third-party behavioral tracking cookies on this Site beyond the Google Analytics service described above.
6. Third-Party Links — LawPay
Our Site contains a link to LawPay, an online payment processing platform operated by AffiniPay, LLC. This link is provided solely as a convenience to existing clients of the Firm who wish to submit payments. When you click the LawPay link, you will leave our Site and be directed to an entirely separate, third-party website operated by AffiniPay, LLC.
The Firm does not operate, control, or maintain the LawPay platform. All payment transactions initiated through LawPay are processed exclusively on AffiniPay’s platform and are governed solely by AffiniPay’s own Privacy Policy and Terms of Service. The Firm does not collect, receive, store, or process any payment card information, banking information, or personal financial information through this Site.
The Firm expressly disclaims any and all responsibility or liability for the privacy practices, data collection activities, security measures, or terms of service of LawPay, AffiniPay, LLC, or any other third-party website that may be linked to or from our Site.
Visitors are strongly encouraged to carefully review LawPay’s Privacy Policy and Terms of Service before submitting any payment information or personal data through that platform.
7. No Contact Forms / No User Accounts
For the avoidance of doubt, the Firm expressly states the following with respect to the current design and functionality of this Site:
- No Online Contact Forms: This Site does not feature any online contact forms, inquiry forms, appointment request forms, or any other web-based submission mechanism. Visitors cannot submit their personal information to the Firm through this website.
- No User Accounts or Registration: This Site does not allow visitors to create accounts, register as users, or log in. There is no member portal, client portal, or password-protected area accessible through this Site.
- No Personal Information Submitted Through the Site: As a direct consequence of the above, no personal information is transmitted to or received by the Firm through this website under normal operation.
Individuals seeking to contact the Firm regarding legal matters, potential representation, billing inquiries, or any other subject must do so through direct communication channels — specifically, by telephone or by visiting the Firm’s office in person. Contact information is provided in Section 13 of this Policy.
Important Notice: Do not attempt to communicate confidential, sensitive, or privileged information through any website-based channel. Please review Section 8 of this Policy regarding the absence of an attorney-client relationship through website contact.
8. Attorney-Client Privilege & Confidentiality Notice
The information contained on this Site is provided for general informational purposes only and does not constitute legal advice. Visiting this Site, viewing its content, or using any feature of this Site does not create an attorney-client relationship between you and Peacock, Gaffney, & Damianakis, P.A., or any attorney associated with the Firm.
An attorney-client relationship with this Firm is established only upon the execution of a formal written engagement agreement signed by both the prospective client and a duly authorized attorney of the Firm. Accordingly, you should not transmit any confidential, sensitive, time-sensitive, or legally significant information through any channel associated with this website. If you believe you have an urgent legal matter, please contact the Firm directly by telephone to speak with a member of our staff.
9. Children’s Privacy
This Site is intended solely for use by adults and is not directed to, designed for, or intended to attract children under the age of thirteen (13). The Firm does not knowingly collect, solicit, receive, store, or use personal information from any child under the age of thirteen.
In accordance with the Children’s Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq., and its implementing regulations, if we become aware that we have inadvertently received personal information from a visitor under the age of thirteen, we will take prompt steps to delete such information from our records.
If you are a parent or guardian and believe that your child under the age of thirteen may have provided personal information through or in connection with this Site, please contact us immediately using the contact information provided in Section 13 of this Policy.
10. Florida Privacy Compliance
The Firm operates under the laws of the State of Florida and is committed to compliance with applicable Florida privacy statutes, including the Florida Information Protection Act (FIPA), Fla. Stat. § 501.171, which governs the protection of personal information and requires covered entities to take reasonable measures to protect and secure data in electronic form containing personal information.
Because this Site does not collect personally identifiable information through web-based forms or user accounts, the volume of personal data processed through this Site is minimal. Nevertheless, the Firm is committed to maintaining appropriate administrative, technical, and physical safeguards to protect any information that may come into our possession in connection with the Site.
Florida residents who believe they have a right to access, correct, or request deletion of personal information held by the Firm in connection with this Site may contact us directly using the information in Section 13. The Firm will respond to all such requests in a reasonable and timely manner, consistent with applicable law.
11. Data Security
The Firm takes reasonable and appropriate measures to protect the limited information collected through this Site against unauthorized access, disclosure, alteration, and destruction. These measures include, but are not limited to, the use of secure hosting environments and industry-standard security configurations for the WordPress platform on which the Site is built.
However, no method of transmission over the internet and no method of electronic data storage is completely secure. While we strive to use commercially reasonable means to protect information associated with this Site, we cannot guarantee absolute security. Any transmission of information in connection with this Site is at your own risk.
In the event of a data breach affecting personal information subject to notification requirements under Florida or federal law, the Firm will comply with all applicable breach notification obligations in a timely manner.
12. Changes to This Policy
The Firm reserves the right to update, modify, or revise this Privacy Policy at any time, at its sole discretion, to reflect changes in our practices, changes to applicable law, or for any other operational, legal, or regulatory reason. All changes will be effective immediately upon posting to the Site.
The “Last Updated” date at the top of this Privacy Policy will be revised whenever a material change is made to the Policy. It is your responsibility to review this Privacy Policy periodically to remain informed of any updates.
Your continued access to or use of this Site following the posting of any changes to this Privacy Policy will constitute your acknowledgment of, and agreement to, those changes. If you do not agree to the revised Policy, you should discontinue use of the Site.
